Terms and Conditions
MOWI is a management tool that connects clients and ground transportation providers. Its purpose is to facilitate that connection between clients and companies for the management of ground transportation with a driver.
Users. Individuals who use the MOWI application and/or website to request Ground Transportation Services.
What services does MOWI provide?
It is a specialized medium to facilitate the sourcing and provision of Ground Transportation Services with a Driver in vehicles legally authorized for this activity. MOWI manages the contact between clients and service providers. All services may be requested through the MOWI application, which can be downloaded to a mobile device (Smartphone), and/or from the website www.mowiapp.com. MOWI acts as the smart, innovative solution for companies and/or the general public by coordinating the request and provision of Ground Transportation Services with a Driver.
Registration
To register any user, accurate and truthful information is required, with which a personal, non-transferable account protected by a password will be created. Use of this account is the responsibility of the person who registers.
For User registration: The information requested by MOWI from users refers to personal data, mobile phone number, email account, location, and payment preferences. MOWI does not request this information outside the application and/or website.
Specifications of accurate and complete information for: Companies, Vehicle Owners:
As the owner of an authorized vehicle, a transportation company, or an independent driver, in order to register with MOWI (the application and website), you are required to provide complete information on your legal and trade name, current permits, and payment and billing information regarding financing arrangements.
Specifications of accurate and complete information for Drivers:
Personal data: name, address, phone number, health certificate, valid driver’s license details, national ID number. Language skills. «Specialties.» Company they belong to, vehicle they drive.
MOWI may cancel a user’s account at any time, whether due to complaints or internal policies.
MOWI is not liable for any damage resulting from the loss or misuse of the password by third parties. The user is solely responsible for it.
Limitations of liability
a) MOWI does not provide transportation services directly; the service it offers is solely that of an intermediary aimed at optimizing the request and provision of Ground Transportation Services with a Driver; that is, it is a tool that interacts with clients and companies to manage services directly with vehicles, ensuring the corresponding authorizations for each transportation modality. The user must understand and accept that MOWI is not liable for any act committed by any user, whether due to theft, disputes, or otherwise; however, feedback from service evaluations will always be collected for the purpose of continuous improvement.
User obligations
The user certifies that they are using the service of their own free will and acknowledges and accepts the responsibilities and risks of using the application and/or website from the moment they have registered.
How to use the Service and the Application
The Application will allow you to send a transportation service request to a Ground Transportation Service Provider with a Driver. The GPS receiver — which must be installed on the mobile device (Smartphone) on which you have downloaded the Application — will detect your location and send that information to the relevant Trip Service Provider. You may also enter the specifications of the transportation required, such as number of passengers, times, dates, etc. Once the Trip Service Provider accepts a request, the Application will notify you and provide information related to it, including their name and license plate number, as well as the option to contact the Provider by phone. The Application also allows you to track the Provider’s progress toward the meeting point in real time.
Specific obligations of the holder of one or more vehicles registered with MOWI
Including proper registration, the holder of one or more vehicles registered to provide Ground Transportation Services with a Driver agrees to: Provide the necessary documents proving the legality of driver’s licenses, the condition of the vehicle, and any other specific condition required by the corresponding private transportation authorities.
They agree to accept and carry out, in a timely manner, the services requested following their registration and signature. Drivers assigned to each vehicle must be available for services requested through MOWI and must show as available in the Application. If not available, they must set themselves as «offline» in order to always maintain a real availability of vehicles to meet the commitments requested by MOWI users.
Protection and processing of personal data
MOWI is committed to maintaining the confidentiality of the requested data in accordance with applicable personal data protection and processing law.
In accordance with these terms and conditions, you grant your express authorization for the processing of your personal data, including express authorization for the international transfer and transmission of your personal data, within the purposes communicated.
Users and drivers, in connection with their use of the MOWI platforms, may receive personal data necessary or relevant for the proper use of said platforms, such as the service request address, names, phone numbers, etc. Under these terms and conditions, you agree not to use or process the personal data you receive for purposes other than requesting or providing a Transportation Service through the MOWI platforms.
General conditions
These Terms of Use shall be governed and interpreted in accordance with the laws of each country, and any dispute arising from this disclaimer that cannot be resolved by the parties shall be submitted to the jurisdiction of the designated city.
By registering as a driver or user in the system and accepting the terms, by clicking «I accept the terms of use,» the User automatically declares and agrees to comply with these terms and all other policies and rules available in the system.
By using the Application or the Service, you also agree that:
- You will only use the Service or download the Application for your personal use and will not resell it to a third party;
- You will not authorize others to use your account, nor will you transfer it.
- You will not use the Service or the Application for unlawful purposes, including, without limitation, to send or store any illegal material or material intended for fraudulent purposes;
- You will not impair the proper functioning of the network;
- You will not copy or distribute the Application or any of its content without MOWI’s written permission;
- You will keep your account password and any identification provided to access the Application and the Website safe and confidential;
- You will provide us with all proof of identity that we may reasonably request;
- You will comply with all applicable laws of your country of residence and of the country, state, or city in which you are located when using the Application or the Web Service.
MOWI reserves the right to immediately terminate the Service and use of the Application if you breach any of the foregoing rules.
Payment
Use of the Application and the Web Service will be free of charge. MOWI reserves the right to introduce a fee for the use of the Application or the Web Service. Should MOWI decide to introduce this fee, MOWI will notify you accordingly and allow you to continue or terminate the Agreement. At all times, users of the application have the option to work specifically with their current company or provider through the use of the MOWI application, or to register directly as a MOWI client so that the application routes the requested service to the nearest, most immediate vehicle that meets their requirements.
You can find information on the rates applicable by the Transportation Service Provider on the Website and through the Application. MOWI may modify or update these rates from time to time. It is your responsibility to stay informed about current rates for transportation services.
MOWI uses a third-party payment processor. Charges will initially be made in cash, by credit card directly with the service provider, or via a current account subject to prior agreement with MOWI’s Administration in Montevideo.
The processing of payments and/or credits, with respect to your use of the Application and the Service, will be subject to the terms and privacy policies of the Payment Processor and your credit card issuer, in addition to these User Terms. MOWI will not be liable for any error by the Payment Processor. In connection with the use of the Services, MOWI will obtain certain transaction data, which it will use solely in accordance with its Privacy Policy and its Cookie Notice.
Notice
MOWI reserves the right, at its discretion, to modify or replace any of these User Terms, or to change, suspend, or discontinue the Application or Web Service (including, without limitation, the availability of any feature, database, or content) at any time by posting a notice on the Website or sending a notice through the Application or by email.
Personal Data Protection
Through the «Mowi Conductor» mobile application, the following personal data will be collected:
- First name
- Last name
- Phone number
- Email address
- Permission to access your camera or gallery. IMPORTANT: Only if the user wishes to update their profile photo.
- Location permissions. IMPORTANT: The user’s location permissions are collected at all times whenever available, so that operators can assign trips based on their location.
Location data
In Mowi Conductor we collect this data (location) from users’ mobile devices if they allow it. This data is obtained from the moment they log in and set themselves as available (indicated by an icon or a notification on their mobile device, depending on their device’s operating system).
If a user does not allow location data to be collected, they will not be able to receive or successfully complete trips, since it is necessary to determine their location in order to calculate, among other things, the distance traveled and the commission to be charged.
Mowi Conductor may display the location on screen, reflected on a map or as text, with accuracy approximate to that obtained by your device, in order to visually indicate to operators where they are currently located.

What will my personal data be used for?
The personal data we collect will be used for the following purposes, which are necessary for the service requested:
- Locating the User in order to determine their exact location in real time, so as to assign them trips in their vicinity.
If the user does not agree to share their geolocation information and system permissions with the «Mowi Conductor» mobile application, please note that it will not be possible for our services to be provided properly.
The user closest to a newly generated trip will receive the alert and, if they accept, will be able to view the route to the destination; in turn, the passenger receives an estimated time for both the driver’s arrival and the total trip duration.
